"You" means the person accessing this website and any organization represented by that person or on whose behalf, whether expressly or impliedly, that person acts.

TERMS OF USE OF THIS WEBSITE

Agreement to be Bound. By accessing the site, continuing to access the site, or downloading materials from the site, you agree to abide by the terms of use set forth in this notice. If you do not agree to abide by these terms of use do not use the site or download materials from the site.

Limited License. Subject to these terms of use, Asahi grants to you a non-exclusive, non-transferable, limited right to access the site and the materials thereon. You may use the site for informational purposes and in connection with the purchase of products from Asahi.

No Interruption. You agree not to interrupt or attempt to interrupt the operation of the site in any way.

Confidential Information. Asahi does not want you to, and you should not, send any confidential or proprietary information to, or post any such information on, the site. With regard to such information:
i. You represent and warrant to Asahi and to all others that may access the site that you own, or possess sufficient rights in, all such information and Asahi and all such parties may freely use and publish such information;

Misuse of the Site. You may not make any statements on, or provide or post any information to the site that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another.

Disclaimer of Warranties. THE SITE AND ALL MATERIALS ARE PROVIDED WITH ALL FAULTS, AND THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY, AND EFFORT IS WITH THE USER. ASAHI FURTHER DISCLAIMS ALL IMPLIED WARRANTIES AS TO INFRINGEMENT OR MISAPPROPRIATION AND FURTHER DISCLAIMS ALL IMPLIED WARRANTIES AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Damages. IN NO EVENT SHALL ASAHI OR ANY OF ITS OWNERS, AFFILIATES OR SUBSIDIARIES BE LIABLE TO ANY ENTITY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION OR PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM) THAT ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE MATERIALS, AND FUNCTIONS OF THE SITE OR ANY LINKED WEB SITE, EVEN IF ASAHI IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Revisions to Terms of Use. Asahi reserves the right, at its sole discretion and without any notice, to change, modify, add or remove any portion of these terms and conditions at any time. Changes in these terms and conditions will be effective when the revised terms and conditions are posted. Your use or continued use of the site after any changes to these terms and conditions are posted will be considered acceptance of those changes.

Changes to the Site. Asahi may terminate, change, suspend, or discontinue any aspect of the site, including the availability of any features of the site, at any time. Asahi may also impose limits on certain features and services or restrict your access to ports or the entire site without notice or liability. Asahi may terminate the authorization, rights and license given above and, upon such termination; you shall immediately destroy all Materials.

International Users and Choice of Law. The site is controlled, operated and administered by Asahi or its agents from its offices within the United States of America. Asahi makes no representation that materials at this site are appropriate or available for transmission to or from, or use in, locations outside of the United States and accessing the site from territories where the site's contents are illegal is prohibited. You may not use the site or export the materials in violation of United States or any other export laws and regulations. If you access this site from a location outside of the United States, you are responsible for compliance with all local laws. The laws of the State of Michigan and the federal laws of the United States (without regard to the choice of law rules of Michigan or the United States) govern these terms of use and performance under them.

Limitation of Actions. Any cause of action you may have with respect to your use of the site must be commenced within one (1) year after the claim or cause of action arises or you waive such cause of action.

Partial Invalidity. If for any reason a court of competent jurisdiction finds any provision of this Agreement or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these terms of use, and the remainder of these terms of use shall continue in full force and effect.

Entire Agreement. These terms of use and the terms of the Privacy Policy bellow constitute the entire agreement between Asahi and you with respect to your use of the site.

PRIVACY POLICY

This privacy policy discloses the privacy practices of Asahi for site. Asahi may have other privacy policies with regard to information not collected using the site, and you should inquire as to the terms of those privacy policies with regard to information collected by means other than the site.

Information Ownership, Collection and Use. Asahi is the sole owner of the information collected on this website. It will not sell, share, or rent this information to others in ways different from those disclosed in this policy. Asahi collects information from its users at several different points on its website.

Registration. In order to use this certain portions of this website, a user must first complete a registration form. During registration each user is required to give its contact information (such as name and e-mail address and possibly additional information). This information is used to contact the user about the services on the website in which the user has expressed interest. Under certain circumstances, it is optional for the user to provide demographic information and unique identifiers, but Asahi encourages users to provide such information so that it can provide a more personalized experience on this website.

Ordering and Related Processes. When users order products or services using the site, Asahi requests information from those users using an order form. Log Files.

Asahi collects traffic information from visitors for statistical analysis and website improvement. When a user accesses this website, Asahi collects information about the user's visit in a log file on the server. Log file information may include, but is not limited to, internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. Asahi uses this information to analyze trends, administer the website, track users' movements in the aggregate, and gather demographic information for aggregate use. IP addresses and other log file information are not linked to personally identifiable information. While Asahi uses good faith efforts to verify that such vendors, suppliers and advertisers promote products and services of interest to site users, Asahi cannot, and does not, endorse such vendors, suppliers, advertisers, products or services unless Asahi expressly states otherwise. Asahi shares only such information as users themselves provide to Asahi (such as through a registration process) and does not share personally identifiable information derived indirectly through IP address tracing or similar means. Newsletter. If a user wishes to subscribe to a newsletter, Asahi collects from the user contact information necessary to send the newsletter to the user. This is usually limited to the user's e-mail address.

Surveys and Contests. From time to time, Asahi may request information from users using surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice as to whether to disclose this information. Site and Service Updates. Asahi also sends website and service announcement updates to users. Users are not able to un-subscribe or opt not to receive service announcements because such announcements contain important information about the services offered through the website.

Correcting or Updating Personal Information. If a user's personally identifiable information changes, or if a user no longer desires service, the user may contact Asahi using the contact information below and Asahi will accommodate all reasonable requests for such changes.

Many such changes are accomplished using batch processing (i.e. collecting a number of similar change requests and making all such changes at once), so the changes may not be immediately effective. It is the policy of Asahi to refrain from knowingly collecting or maintaining personally identifiable information relating to any person under the age of 18.
